Nomad Fuel Inc. (“Nomad”, “we”, “our”) acknowledges the importance and necessity of safeguarding personal information (“personal information”) belonging to our clients. The purpose of this privacy policy (the “Policy”) is to explain how and for what purposes we collect, use, share or otherwise process your personal information and how we safeguard the confidentiality of your personal information, whenever you interact with us when participating in a fuel card program, using our online client information portal (the “Nomad Portal”, accessible through the following domain[s] [www.nomad.io], using a fuel card (“Card”), or otherwise using our services.
In some cases, at the time of collection of your personal information, we may provide you with additional information regarding the processing of your personal information. We may also, in certain circumstances, obtain your specific consent to the use or sharing of your personal information, including where required by law.
In this Policy, the term “personal information” refers to any information (in any format) that relates to an individual and that directly or indirectly identifies the individual.

We collect personal information in a variety of ways, including directly from you, from third parties and through the Nomad Portal.
A. Directly From You
We may collect personal information directly from you, such as when you become our client, create an account, contact us with an inquiry or to report a problem with the Nomad Portal, the Card or services.
B. From Third Parties
In certain circumstances, we may receive personal information from third parties, affiliates and service providers, including when you provided your consent for credentials verification.
C. Through the Nomad Portal
Nomad collects technical information (e.g., your IP address, browser type and device ID) and information about your device and browser (e.g., page views and clickstream data) when you visit the Nomad Portal, using technologies, such as cookies. Some of these technologies may be operated by third parties. This information supports the functioning of the Nomad Portal and helps us understand how you navigate and use the Nomad Portal. We may share your personal information with our business partners and our service providers (companies that carry out activities on our behalf), and in the context of a sale or transfer of our business or similar transaction. We may also share your personal information with your consent or in accordance with applicable law.

B. Service Providers
We may share personal information with our agents, vendors or other organizations that provide services on our behalf, for the purposes set out in this Policy. These service providers help us operate and manage the Nomad Portal, information systems, infrastructure and marketing. They provide services to us, such as email communications, mail delivery, data hosting and analytics services (e.g. analyzing usage of the Nomad Portal).
When Nomad shares personal information with our service providers, we ensure by contractual means that the transferred personal information is used only for the purposes for which the service provider is retained and is protected to the same degree as it is when in our possession. Our service providers may be located around the world, as further detailed in the “Cross-Border Transfer of Personal Information” section below.
C. Sale or Transfer of Our Business or Other Transaction
We may decide to sell or transfer all or part of our business to a third party, merge with another entity, secure our assets or proceed with any other financing or other strategic capital transactions (including insolvency or bankruptcy proceedings), restructuring, share sale or other change in corporate control. A. Changing Your Cookie Preferences
When you first visit the Nomad Portal, you will be presented with a pop-up banner that allows you to make choices regarding your cookie preferences. By default, only necessary cookies are activated on the Nomad Portal. You can choose to enable or disable some or all of these cookies but disabling some of them may affect your browsing experience.
B. Restricting Collection, Use and Disclosure of Your Personal Information
You may withdraw your consent to the collection, use and disclosure of personal information in accordance with this Policy at any time upon reasonable notice to Nomad in writing, subject to legal or contractual restrictions. The withdrawal of your consent may affect our ability to answer your inquiries and/or provide you services. In certain situations, we may be entitled to retain your personal information in order to comply with applicable legal requirements, to establish, exercise or defend our rights or legal claims, and for other legitimate business purposes described under “How Do We Use Personal Information”
Some of our service providers may access, process or store your personal information outside of the country where we are located and where you reside, including in Canada and the United States. As a result, when your personal information is used or stored in a jurisdiction other than where you are residing, it may be subject to the law of this foreign jurisdiction, including any law permitting or requiring disclosure of the information to the government, government agencies, courts and law enforcement in that jurisdiction.
Nomad will only retain personal information for as long as it is needed in order to satisfy the stated purposes at the time of collection. When the information is no longer required, we will take the necessary measures to destroy, dispose of, or erase the information, subject to any other legal or regulatory requirements. If a client decides to terminate their relationship with Nomad, we will continue to adhere to the privacy policies and practices outlined in this Policy.
Nomad maintains appropriate policies and practices aimed at safeguarding your personal information. Depending on the volume and sensitivity of the information, the purposes for which it is used and the format in which it is stored, we implement a combination of measures to protect your personal information.
Nomad has established policies, procedures, guidelines and security measures in order to ensure that personal information is protected against loss, unauthorized access and use, theft or improper disclosure. Internal policies and procedures that define the roles and responsibilities of our employees throughout the information life cycle and limits their access to such information on a “need-to-know” basis have also been established. Security measures include controlled access to Nomad’s office and records within the office, password requirements to access Nomad’s networks and systems, restricted access to information stored in Nomad systems as well as technical measures such as such as encryption, firewalls, passwords, antivirus software and similar measures. All Nomad staff are subject to privacy procedures when dealing with personal information and are responsible for ensuring the confidentiality of any information that is accessed. We have also a designated Privacy Officer to monitor Nomad’s compliance with applicable privacy laws.
You may be entitled to access your personal information and request the rectification of information that is inaccurate, incomplete or no longer up to date, subject to limited exceptions set out in applicable laws. Depending on the jurisdiction where you reside, you may also be entitled to request the rectification of your personal information if our collection, disclosure or retention of such information is not authorized by law.

We may make changes to this Policy from time to time at our sole discretion. Any changes we make will be effective when we post the revised policy on the Nomad Portal. If we make any significant changes to the Policy, we will post a notice on the Nomad Portal or contact you to inform you when required by law. By continuing to interact with us after the modified version of the Policy has been posted, you are accepting the changes to the Policy, subject to any additional requirements that may apply. It is your responsibility to ensure that you read, understand and accept the latest version of the Policy. The “Effective Date” at the top of this Policy indicates when it was last updated.
